NO PAYMENT REQUIRED. A TICKET PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING. SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES, DISTRICT OF COLUMBIA AND CANADA (EXCLUDING QUEBEC), 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY. VOID IN PUERTO RICO, QUEBEC, AND WHERE PROHIBITED BY LAW.
SWEEPSTAKES PERIOD: “Win Spot A Cheap Sports Car” Raffle begins at 12:01:00 a.m. Mountain Standard Time (“MST”) on August 3, 2021 and ends at 12:00:00 p.m. on September 13, 2021.
ELIGIBILITY: Open to legal residents of the 50 United States, District of Columbia and Canada (excluding Quebec), 18 years of age or older at time of entry. Void in Puerto Rico, Quebec, and where prohibited or restricted by law.
HOW TO ENTER: There are two ways to enter: 1) Purchasing tickets via our online raffle page at https://rafflecreator.com/pages/23848/cheap-sports-car-give-away. There is no limit to the number of tickets that can be purchased by one person and each qualifies as an equal entry. 2) To enter without purchase, entrants must hand write the following: entrant name, address, city, state/province, zip/postal code, e-mail address, telephone number and date of birth on a 3x5 postcard in an envelope and mail to: Everyday Driver Cheap Sports Car Sweepstakes, P.O. Box 980812 Park City, Utah 84098 for 1 entry. Mail in entries will have the same chance of winning as purchased tickets. Mail-in entries must received by September 10, 2021.
SELECTING THE WINNER: If the sweepstakes reaches 400 ticket sales, the winner(s) will be randomly selected via computer using the RaffleCreator random selection process. The Grand Prizes will be drawn in the order listed below. Two (2) total Grand Prize winners will be selected. This drawing will be conducted on or about September 13, 2021. Odds of winning a Grand Prize depend on the number of eligible entries received.
PRIZES:
Grand Prize 1- 2004 BMW Z4 3.0i: Todd’s long term cheap sports car with approximately 120,000 miles on the odometer. Also includes all extras and parts including sunscreen, car cover, winter wheels and tires, and all service records in Todd’s possession. The Z4 is offered “as-is”. Any service needs or mechanical issues will be the responsibility of the winner.
The approximate value of Grand Prize is $5,000.
Grand Prize 2- 2006 Mercedes SLK 280: Paul’s long term cheap sports car with approximately 158,000 miles on the odometer. Also includes all extras and parts including sunscreen, car cover, winter wheels and tires, and all service records in Paul’s possession. The SLK is offered “as-is”. Any service needs or mechanical issues will be the responsibility of the winner.
The approximate value of Grand Prize is $5,000.
GRAND PRIZE DETAILS: The winner of either the Z4 or the SLK is responsible for registration, license, title and insurance fees and any other expenses related to acceptance and use of prize and must provide a valid driver’s license and evidence of insurance prior to delivery. The Grand Prizes must be picked up by Winner(s) in Park City, UTAH no later than October 1, 2021 (unless other arrangement are made and agreed upon in writing by Everyday Driver). Winner is responsible for all costs and fees associated with picking up prize (including but not limited to airfare, gas, temporary registration, insurance, towing fees, etc...). The prize is awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Failure to take delivery within 30 days of availability could cause prize to be forfeited and awarded to an alternate. Prize Winner is responsible for the payment of taxes on the prize and for any other costs and expenses associated with the acceptance and use of the prize.
GENERAL RULES: Potential Winners will be notified by phone, email or mail on or about September 13, 2021. Should the potential Winner (or any other alternate potential Winner) decide to decline the prize for any reason whatsoever, Everyday Driver shall have no further obligation to that potential Winner, and an alternate potential Winner will be selected, if time permits. Taxes related to the prize are the sole responsibility of the Winner. Acceptance of a prize constitutes permission for Everyday Driver to use Winner’s name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. By accepting a prize, Winner agrees to hold Everyday Driver harmless against any and all claims and liability from any accident, loss or injury occurring from this promotion or in any way related to the prize or use/misuse thereof, or while traveling to and/or from a location to obtain or use a prize.
In the event that 400 tickets are not sold, entries fees will be returned and the Grand Prizes will remain in the possession of Everyday Driver.
WAIVERS, DISCLAIMERS, RELEASES, INDEMNITY: BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY
APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE RAFFLE, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS (US $10.00), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE.
EACH PARTICIPANT AGREES (I) TO ABIDE BY THE TERMS OF THESE OFFICIAL RULES AND THE DECISIONS OF THE RAFFLE ENTITIES WHICH ARE FINAL AND BINDING ON ALL MATTERS RELATING TO THIS SWEEPSTAKES, AND (II) TO RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL CLAIMS OR LIABILITY IN CONNECTION WITH PARTICIPATION IN THIS SWEEPSTAKES OR ACCEPTANCE OR USE OF ANY PRIZE INCLUDING, WITHOUT LIMITATION, ANY ACTIVITY RELATED THERETO.
CHOICE OF LAW AND JURISDICTION: This Promotion is offered only in the United States (excluding Puerto Rico) and Canada (excluding Quebec) and is governed by the laws of the State of Utah. By entering, entrants irrevocably consent to the sole and exclusive jurisdiction of the courts of the State of Utah located in Utah County for any action, suit or proceeding arising out of or relating to this Promotion.
